City finds that unmarked cars can increase their liability in an accident.

A jury in Middletown, Connecticut has ruled in favor of a man who hit an unmarked police car.

The city was seeking approximately $10,000 from the man and his insurance company, arguing that the man was at fault. Several witnesses gave conflicting testimonies as to whether the crusiers lights and sirens were on. The defendant argued that he did not see the unmarked police cruiser coming until it was too late to avoid the accident.

The accident happened at a broken traffic signal that had been flashing red for a couple of weeks. The man was cited for failing to obey a traffic signal. 

Some officers expressed concern as to why the city was suing, as the insurance company had offer to settle for only slightly less than the $10,000 sought in the case.

The jury found that the city was more liable than the man in the accident, and did not award any damages to the city.

Presumably, the man could counter-sue the city, but there was no mention of a counter-suit.
